เงื่อนไขการใช้งาน

ยินดีต้อนรับสู่ GoThaiMassage ("แพลตฟอร์ม", "เรา") การเข้าใช้งานหรือสมัครบัญชีถือว่าท่านได้อ่าน เข้าใจ และยอมรับเงื่อนไขฉบับนี้แล้ว หากไม่ยอมรับ กรุณางดใช้งาน

1. ลักษณะบริการ

GoThaiMassage เป็นตลาดกลาง (marketplace) ที่เชื่อมต่อผู้ใช้บริการกับหมอนวดอิสระและร้านนวด เราเป็นเพียงตัวกลางอำนวยความสะดวกในการค้นหาและจอง มิใช่ผู้ให้บริการนวดเอง สัญญาการให้บริการนวดเกิดขึ้นระหว่างผู้ใช้กับผู้ให้บริการโดยตรง

2. คุณสมบัติผู้ใช้

ท่านต้องมีอายุไม่ต่ำกว่า 18 ปี หรือได้รับความยินยอมจากผู้ปกครอง และมีความสามารถทางกฎหมายในการทำสัญญา

3. บัญชีและบทบาท

• มี 3 บทบาท: ลูกค้า, หมอนวดอิสระ, และร้านนวด
• ท่านต้องให้ข้อมูลที่ถูกต้องและเป็นปัจจุบัน
• ท่านมีหน้าที่รักษารหัสผ่านและรับผิดชอบกิจกรรมทั้งหมดภายใต้บัญชีของท่าน

4. การจองและการชำระเงิน

• ราคากำหนดโดยผู้ให้บริการ ชำระเงินให้แพลตฟอร์มผ่านการสแกน QR Code ของธนาคาร หรือผ่าน PayPal เมื่อต้องการชำระด้วยบัตรเครดิต
• แพลตฟอร์มเรียกเก็บค่าธรรมเนียม 10% ต่อการจองทุกแผน
• ท่านตกลงชำระค่าบริการและค่าธรรมเนียมที่เกี่ยวข้องทั้งหมด

5. การยกเลิกและการคืนเงิน

หากท่านชำระเงินแล้วและต้องการเปลี่ยนร้านนวดหรือหมอนวด ท่านต้องยกเลิกการจองเดิมก่อน หากต้องการเงินคืน กรุณาแจ้งผ่านแชทช่วยเหลือ ทีมงานจะดำเนินการคืนเงินภายใน 24 ชั่วโมง

ค่าบริการของผู้ให้บริการ (ร้านนวด/หมอนวดอิสระ) จะเริ่มโอนให้ทุกวัน ตั้งแต่เวลา 22:00 น. เป็นต้นไปจนครบ สำหรับงานที่ให้บริการเสร็จสมบูรณ์ หักค่าธรรมเนียมแพลตฟอร์ม 10%

6. หน้าที่ของผู้ให้บริการ (หมอนวด/ร้านนวด)

• ต้องมีใบอนุญาต/คุณวุฒิตามที่กฎหมายกำหนด และให้บริการอย่างถูกกฎหมาย
• การส่งเอกสารยืนยันตัวตน/ใบรับรองเป็นทางเลือก — ใช้งานได้โดยไม่ต้องส่ง แต่จะไม่ได้รับเครื่องหมายยืนยันตัวตน (verified)
• ห้ามเด็ดขาด: การให้บริการที่ผิดกฎหมาย บริการทางเพศ หรือการแอบอ้าง

7. การกระทำที่ห้าม

ห้ามใช้แพลตฟอร์มเพื่อการผิดกฎหมาย ฉ้อโกง คุกคาม ละเมิดสิทธิผู้อื่น ส่งข้อมูลเท็จ หรือพยายามเจาะระบบ

8. รีวิวและเนื้อหา

เนื้อหาที่ท่านโพสต์ต้องเป็นความจริงและไม่ละเมิดสิทธิผู้อื่น เราขอสงวนสิทธิ์ในการลบเนื้อหาที่ไม่เหมาะสม

9. การตรวจสอบและระงับบัญชี

เราขอสงวนสิทธิ์ในการระงับหรือยกเลิกบัญชีที่ละเมิดเงื่อนไข หรือก่อความเสี่ยงต่อผู้ใช้รายอื่น

10. ทรัพย์สินทางปัญญา

เครื่องหมายการค้า โลโก้ และเนื้อหาบนแพลตฟอร์มเป็นของ GoThaiMassage ห้ามนำไปใช้โดยไม่ได้รับอนุญาต

11. ข้อจำกัดความรับผิด

แพลตฟอร์มให้บริการ "ตามสภาพที่เป็น" เราไม่รับผิดชอบต่อคุณภาพการบริการนวด ความเสียหาย หรือข้อพิพาทที่เกิดขึ้นระหว่างผู้ใช้กับผู้ให้บริการ เท่าที่กฎหมายอนุญาต

12. ความรับผิดกรณีใช้งานผิดวัตถุประสงค์

หากท่านใช้แพลตฟอร์มโดยผิดกฎหมาย หรือละเมิดเงื่อนไขอย่างร้ายแรงจนก่อให้เกิดความเสียหายหรือการเรียกร้องจากบุคคลภายนอก ท่านตกลงรับผิดชอบตามส่วนที่เกี่ยวข้อง ทั้งนี้ ข้อนี้ไม่กระทบสิทธิของผู้บริโภคตามกฎหมาย

13. กฎหมายที่ใช้บังคับ

เงื่อนไขนี้อยู่ภายใต้กฎหมายแห่งราชอาณาจักรไทย

14. การเปลี่ยนแปลงเงื่อนไข

เราอาจปรับปรุงเงื่อนไขเป็นครั้งคราว การใช้งานต่อหลังการเปลี่ยนแปลงถือว่าท่านยอมรับเงื่อนไขฉบับใหม่

15. การคุ้มครองข้อมูลส่วนบุคคล

การเก็บและใช้ข้อมูลส่วนบุคคลเป็นไปตาม นโยบายความเป็นส่วนตัว ของเรา

Terms of Service

Welcome to GoThaiMassage (the "Platform", "we"). By accessing the Platform or creating an account, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use the Platform.

1. Nature of the service

GoThaiMassage is a marketplace that connects customers with independent therapists and massage shops. We are an intermediary that facilitates discovery and booking — we are not the provider of the massage services. The service contract is formed directly between the customer and the provider.

2. Eligibility

You must be at least 18 years old (or have guardian consent) and legally able to enter into contracts.

3. Accounts and roles

• There are three roles: customer, independent therapist, and shop.
• You must provide accurate, current information.
• You are responsible for safeguarding your password and for all activity under your account.

4. Bookings and payments

• Prices are set by providers. Payments are made to the Platform via bank QR code scan, or via PayPal when paying by credit card.
• The Platform charges a 10% commission per booking on every plan.
• You agree to pay all applicable service charges and fees.

5. Cancellations and refunds

If you have already paid and wish to change shop or therapist, you must cancel the existing booking first. To request a refund, please notify us via support chat; we will process the refund within 24 hours.

Provider earnings (shops / independent therapists) are paid out daily from 22:00 onwards until all are processed, for completed services, less the 10% platform fee.

6. Provider obligations (therapists/shops)

• Must hold required licences/qualifications and provide services lawfully.
• Submitting identity documents/certificates is optional — you can use the Platform without them, but you will not receive the verified badge.
• Strictly prohibited: illegal services, sexual services, or impersonation.

7. Prohibited conduct

Do not use the Platform for unlawful, fraudulent, harassing, or rights-infringing purposes, to submit false information, or to attempt to breach security.

8. Reviews and content

Content you post must be truthful and must not infringe others' rights. We may remove inappropriate content.

9. Verification and suspension

We may suspend or terminate accounts that breach these Terms or pose a risk to other users.

10. Intellectual property

Trademarks, logos, and content on the Platform belong to GoThaiMassage and may not be used without permission.

11. Limitation of liability

The Platform is provided "as is". To the extent permitted by law, we are not liable for the quality of massage services, damages, or disputes arising between users and providers.

12. Responsibility for misuse

If you use the Platform unlawfully or commit a serious breach of these Terms that causes damage or a third-party claim, you agree to take responsibility to the extent applicable. This clause does not affect your statutory consumer rights.

13. Governing law

These Terms are governed by the laws of the Kingdom of Thailand.

14. Changes to these Terms

We may update these Terms from time to time. Continued use after changes constitutes acceptance of the updated Terms.

Collection and use of personal data are governed by our Privacy Policy.
